At BS Marson & Sons Ltd, we aim to provide complete transparency and confidence when purchasing a vehicle. This Cancellation Policy explains your rights, our obligations, and the procedures for cancelling an order or returning a vehicle.

1. Cancellation of Vehicle Orders (In-Person Purchases)

When you place an order in person at our dealership, a binding contract is formed.

Deposits: All deposits are non-refundable unless otherwise agreed in writing.
Order Cancellations: If you choose to cancel your order after it has been placed, BS Marson & Sons Ltd reserves the right to retain your deposit and recover any reasonable costs incurred as a result of the cancellation.
Special Orders: Vehicles ordered to specific customer requirements (e.g., factory builds or customised specifications) cannot be cancelled once the order has been submitted to the manufacturer.

2. Online & Distance Purchases – Deposits

For vehicles ordered online or at a distance, any deposit paid is fully refundable if you choose to cancel your order within the applicable 14-day cancellation period under the Consumer Contracts Regulations.

If you cancel before collection or delivery, your deposit will be refunded in full.
If you cancel after receiving the vehicle (but within 14 days), the deposit will be refunded as part of the total amount returned to you, minus any allowable deductions for usage or damage.
Refunds will be issued within 14 days of confirming cancellation (or after the vehicle is returned, if applicable).

This amendment applies only to online/distance-selling deposits. Deposits taken in person at the dealership remain non-refundable unless otherwise agreed in writing.

14-Day Right to Cancel

You may cancel your purchase within 14 days of receiving the vehicle, without giving any reason.
To exercise this right, you must notify us in writing using the contact details at the bottom of this page.

Conditions of Return

The vehicle must be returned in the same condition it was supplied, subject to fair usage.
You are responsible for any diminished value caused by handling the vehicle beyond what is necessary to establish its nature, characteristics, and functioning.
Any additional mileage driven during the 14-day period may be subject to a reasonable charge per mile.
You are responsible for the costs of returning the vehicle to our dealership unless otherwise agreed.

Refunds

Once the vehicle is returned and inspected, we will issue a refund within 14 days, minus any permitted deductions for usage or damage.

3. Cancellation of Finance Agreements

If your vehicle purchase includes a finance agreement:

You may have a separate right to withdraw from the finance contract within 14 days, as outlined by your lender.
Withdrawing from the finance agreement does not cancel your vehicle purchase. You will be required to pay the outstanding balance directly to BS Marson & Sons Ltd.

4. Collection and Delivery Charges

If your order involved delivery:

Delivery charges may be non-refundable if cancellation occurs after delivery has taken place.
If the vehicle is returned under the 14-day cancellation period, you are responsible for arranging and paying for its return, unless otherwise agreed.

6. Exceptions

Your cancellation rights may not apply in the following circumstances:

Vehicles purchased in-person at the dealership
Vehicles customised to your personal specification
Business vehicle purchases
Vehicles purchased through certain finance or leasing schemes where different rules apply

7. Amendments to This Policy

BS Marson & Sons Ltd reserves the right to update or modify this Cancellation Policy at any time. Any changes will be posted on our website with an updated effective date.

B S Marson and Sons Limited is an Appointed Representative of Automotive Compliance Ltd who is authorised and regulated by the Financial Conduct Authority (FCA No. 497010). Automotive Compliance Ltd’s permissions as a Principal Firm allows B S Marson and Sons Limited to act as a credit broker, not a lender, for the introduction to a limited number of lenders, and to act as an agent on behalf of the insurer for insurance distribution activities only.
We are a credit broker and not a lender. We can introduce you to a carefully selected panel of lenders, which includes manufacturer lenders linked directly to the franchises that we represent. We act on behalf of the lender for this introduction and not as your agent. We are not impartial, and we are not an independent financial advisor.
Our approach is to introduce you first to the manufacturer lender linked directly to the particular franchise you are purchasing your vehicle from, who are usually able to offer the best available package for you, taking into account both interest rates and other contributions. If they are unable to make you an offer of finance, we then seek to introduce you to whichever of the other lenders on our panel is able to make the next most suitable offer of finance for you. Our aim is to secure a suitable finance agreement for you that enables you to achieve your financial objectives.

If you purchase a vehicle, in the majority of cases, we will receive a commission from your lender for introducing you to them which is either a fixed fee, or a fixed percentage of the amount that you borrow. This may be linked to the vehicle model you purchase.
Different lenders pay different commissions for such introductions, and manufacturer lenders linked directly to the franchises that we represent may also provide preferential rates to us for the funding of our vehicle stock and also provide financial support for our training and marketing. But any such amounts they and other lenders pay us will not affect the amounts you pay under your finance agreement; however, you will be contributing towards the commission paid to us with the interest collected on your repayments. Before we propose you to a potential lender, we will inform you of the likely amount of commission we will receive and seek your consent to receive this commission. The exact amount of commission that we will receive will be confirmed prior to you signing your finance agreement.
All finance applications are subject to status, terms and conditions apply, UK residents only, 18s or over. Guarantees may be required.
